By engaging with Visage Aesthetics, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1.1 Binding Agreement

Your engagement with Visage Aesthetics begins when you take any of the following actions: submitting a booking inquiry, paying a deposit, signing a service agreement, scheduling a treatment session, participating in a consultation, or receiving any services. Upon taking any of these actions, you agree to be bound by all terms and conditions contained within this document.

1.2 Legal Capacity

By accepting these Terms, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this binding agreement. You further warrant that you have the financial means to fulfill all payment obligations and are not under any legal impediment that would invalidate this agreement.

2. Services Overview

2.1 Aesthetic Injection Services

Our professional aesthetic services encompass injectable treatments designed to meet your cosmetic enhancement needs. All treatments are performed by our qualified nurse injector. We conduct all treatment sessions at our clinic located in Upland, California. Each session includes the following elements and requirements:

Clinic Environment and Equipment

We provide a professional clinical environment equipped with standard medical-grade equipment for all sessions. We maintain a clean, sterile environment that meets all health and safety standards. All equipment and products used in your treatment are professional-grade, FDA-approved where applicable, and maintained to industry standards.

Session Delivery and Timeline

Following your aesthetic treatment session, we will process and complete your service according to these specifications:

  • You will receive comprehensive aftercare instructions.

  • Your treatment will be performed during your scheduled appointment time.

  • Your medical records and treatment plans will be properly documented and maintained.

  • Follow-up consultation is included with your treatment as needed.

  • Touch-up sessions may be available when medically appropriate.

  • We maintain confidential medical records in compliance with all applicable regulations.

3. Payment Terms

3.1 Fee Structure and Payment Requirements

All services provided by Visage Aesthetics require payment according to the following terms and conditions:

Deposit and Booking

A non-refundable deposit of fifty percent (50%) of the total service fee is required to secure any service booking. This deposit serves as a commitment to the treatment and reserves your dedicated appointment time. The deposit will be applied to the total service fee but is not refundable under any circumstances.

Payment Methods

We accept payment through approved credit cards and bank transfers. All payments must be made in United States Dollars. Any fees associated with payment processing, including international transaction fees, will be the responsibility of the client. We do not accept cash payments or cryptocurrency.

3.2 Late Payments and Penalties

We maintain strict policies regarding late payments to ensure timely service delivery:

Late Payment Consequences

If any payment is not received by its due date, the following consequences will apply:

  • A late fee of seventy-five dollars ($75) will be automatically assessed.

  • All appointments and services will be suspended until payment is received.

  • After thirty (30) days of delinquency, the account may be sent to collections.

  • The client will be responsible for all costs associated with collections efforts.

3.3 Pricing Confidentiality

Our pricing structure includes special discounts and rates that require strict confidentiality:

  • Immediate termination of any active discounts

4. Intellectual Property Rights

4.1 Ownership and Copyright

Treatment Documentation Ownership

All medical records, before/after photographs, treatment plans, and related materials created by Visage Aesthetics remain our exclusive intellectual property, subject to patient rights to access medical records as required by law. This ownership includes:

  • All medical documentation and records

  • All treatment photographs delivered through our secure systems

  • All consultation notes and documentation

  • All treatment plans and protocols

  • All client forms and questionnaires

4.2 Licensed Usage Rights

Treatment Documentation License Terms

Upon full payment, clients receive limited rights to treatment documentation under these specific conditions:

Permitted Uses:

  • Personal social media posts with required credit to Visage Aesthetics

  • Personal before/after comparisons for private use

  • Sharing with medical professionals for continuity of care

  • Personal records for treatment history

Prohibited Uses:

  • Commercial licensing without a separate agreement

  • Sale or transfer of documentation to third parties

  • Contest submissions without written consent

  • Editorial use without express permission

  • Advertising beyond the scope of your license

  • Any modification, filtering, or alteration of images

5. Service Delivery

5.1 Aesthetic Treatment Service Delivery

Delivery Timeline

Visage Aesthetics adheres to professional standards for all aesthetic services. Your treatment will be performed during your scheduled appointment time. Our business days are defined as Wednesday through Sunday, and services may be extended by holidays or force majeure events.

Treatment Specifications

All treatments will be delivered according to these specifications:

  • Your treatment will be performed by our licensed, qualified nurse injector.

  • All products used will be FDA-approved when applicable.

  • Your medical history and contraindications will be reviewed before treatment.

  • You will receive comprehensive aftercare instructions.

  • Your treatment records will be maintained securely in compliance with medical privacy laws.

  • Follow-up consultation is available as needed within clinical guidelines.

6. Client Responsibilities

6.1 General Obligations

Communication Requirements

As a client of Visage Aesthetics, you agree to maintain professional and timely communication throughout our engagement:

  • You must respond to all appointment-related communications within forty-eight (48) hours.

  • You must provide accurate and current contact information at all times.

  • You must attend all scheduled appointments, sessions, or consultations as agreed.

  • You must provide written notice at least twenty-four (24) hours in advance of any appointment cancellation.

  • You must maintain a professional and courteous demeanor in all interactions.

6.2 Service-Specific Responsibilities

Aesthetic Treatment Client Obligations

When engaging our aesthetic services, you agree to the following requirements:

  • You must arrive at your scheduled appointment on time and prepared.

  • You must provide complete and accurate medical history information.

  • You must disclose all medications, supplements, and treatments currently in use.

  • You must follow all pre-treatment and post-treatment instructions.

  • You must notify us of any specific requirements or health concerns in advance.

  • You must inform us immediately of any adverse reactions following treatment.

7. Cancellation and Rescheduling Policies

Visage Aesthetics maintains a strict cancellation policy for all aesthetic services. Upon booking an appointment, you acknowledge and agree to the following terms:

  • Your booking deposit is non-refundable under any circumstances.

  • Credit for future services will not be provided in lieu of refunds.

8.2 Disclaimer of Specific Results

Visage Aesthetics explicitly disclaims any guarantee of specific results, including:

  • We cannot guarantee specific aesthetic outcomes beyond what is medically reasonable.

  • Individual results from aesthetic treatments vary based on physiological factors.

  • Duration of results varies based on individual metabolism and lifestyle factors.

  • Response to treatment is unique to each individual's physiology.

External Factors

We explicitly disclaim responsibility for circumstances beyond our control, including:

  • Individual healing responses and physiological reactions.

  • Pre-existing conditions affecting treatment outcomes.

  • Client compliance with pre and post-treatment instructions.

  • Changes in client's health status between treatments.

  • Natural aging processes affecting treatment longevity.

9. Liability and Indemnification

9.1 Limitation of Liability

Visage Aesthetics' liability shall be strictly limited under the following terms:

  • Our maximum liability shall not exceed the total amount paid for services under this agreement.

  • We shall not be liable for any consequential or indirect damages.

  • We shall not be responsible for lost income or time.

  • We shall not be liable for any third-party claims against the client.

  • We shall not be liable for damages resulting from client's failure to follow instructions.

9.2 Client Indemnification

Scope of Indemnification

The client agrees to indemnify, defend, and hold harmless Visage Aesthetics against any claims arising from:

  • Client's failure to disclose relevant medical information.

  • Client's breach of these Terms of Service.

  • Client's violation of any laws or regulations.

Coverage of Indemnification

The client's indemnification obligation shall include coverage of:

  • All reasonable legal fees and expenses incurred in defense.

  • Court costs and filing fees related to claims.

  • Settlement costs approved by the client.

  • Expert witness fees and related expenses.

  • Administrative costs related to claim defense.

10. Confidentiality

10.1 Protected Information

Definition of Confidential Information

The following categories of information shall be considered confidential:

  • All client medical information and treatment records.

  • All pricing information and special offers provided to the client.

  • All business processes and methodologies used in service delivery.

  • All client lists and treatment details maintained by Visage Aesthetics.

  • All strategic plans and business development information.

  • All technical processes and proprietary methods.

Treatment-Specific Confidentiality

The following treatment elements shall be maintained as confidential:

  • All client treatment plans and medical information.

  • All client feedback and revision requests.

  • All custom solutions developed for specific treatments.

  • All communication regarding treatment development.

10.2 Confidentiality Obligations

Duration of Obligations

Confidentiality obligations shall persist according to these timeframes:

  • Medical information shall be protected in accordance with applicable laws.

  • Business information shall be protected for five (5) years.

  • Project details shall be protected for two (2) years.

  • These obligations shall survive the termination of services.

Permitted Disclosures

Information may only be disclosed under these specific circumstances:

  • When required by law or court order after notice to the other party.

  • When necessary for regulatory compliance with notice to the other party.

  • When authorized in writing by the information owner.

  • When disclosed to professional advisors under confidentiality obligations.

  • When required in an emergency to protect health or safety.

  • When the information has become publicly available through no fault of the recipient.

11. Force Majeure

11.1 Force Majeure Events

Natural Events

Visage Aesthetics and the client acknowledge that the following natural events shall constitute force majeure when they prevent or substantially impair service delivery:

  • Natural disasters including earthquakes, floods, and hurricanes.

  • Severe weather conditions that make service delivery unsafe or impossible.

  • Wildfires or other environmental emergencies affecting our service area.

  • Public health emergencies or pandemics declared by governing authorities.

  • Environmental disasters affecting our facility or service locations.

  • Any other natural event beyond reasonable human control.

Human Events

The following human-caused events shall also constitute force majeure when they prevent or substantially impair service delivery:

  • Acts of war or terrorism affecting our service area.

  • Civil unrest or riots preventing safe service delivery.

  • Government actions or regulations that prohibit service delivery.

  • Labor disputes or strikes affecting critical services.

  • Widespread infrastructure failures affecting our ability to operate.

  • All educational materials are delivered in their current state, as is.

  • Educational materials are non-refundable upon delivery or access granted.

  • Educational materials may be updated or modified at our sole discretion.

When receiving our educational materials, you agree to these usage restrictions:

  • Educational materials are for personal use only.

  • Sharing, reselling, or redistributing educational materials is strictly prohibited.

  • Educational materials may not be used to create competing products or services.
